AGREEMENT 宿泊約款

AGREEMENT
宿泊約款

Article 1 (Scope of Application)
Accommodation contracts and related agreements concluded between the hotel and guests shall be governed by these Terms and Conditions. Any matters not stipulated herein shall be governed by applicable laws and regulations or by generally established customs.
2.Notwithstanding the provisions of the preceding paragraph, if the hotel agrees to a special arrangement that does not violate any laws or established customs, such special arrangement shall take precedence.
Article 2 (Application for Accommodation Contract)
A person who intends to apply for an accommodation contract with the hotel shall provide the following information to the hotel:
  • (1)Name of the guest(s)
  • (2)Date(s) of stay and expected time of arrival
  • (3)Accommodation charges (in principle, based on the basic accommodation rates set forth in Appendix Table 1)
  • (4)Any other matters deemed necessary by the hotel
2.If a guest requests to extend their stay beyond the date(s) specified in Item (2) of the preceding paragraph during their stay, the hotel shall treat such request as a new application for an accommodation contract at the time the request is made.
Article 3 (Conclusion of Accommodation Contract, etc.)
The accommodation contract shall be deemed concluded when the hotel has accepted the application set forth in the preceding article. However, this shall not apply if the hotel can prove that it did not accept the application.
2.When the accommodation contract has been concluded in accordance with the preceding paragraph, the guest shall pay, by the date specified by the hotel, a deposit determined by the hotel, up to the amount of the basic accommodation charges for the period of stay (or for three days if the stay exceeds three days).
3.The deposit shall first be applied toward the accommodation charges ultimately payable by the guest. In the event that circumstances arise requiring the application of Article 6 and Article 18, the deposit shall be applied first to any cancellation charges and then to compensation for damages. Any remaining balance shall be refunded at the time of payment of charges in accordance with Article 12.
4.If the deposit specified in Paragraph 2 is not paid by the date designated by the hotel pursuant to that paragraph, the accommodation contract shall become void. However, this shall apply only if the hotel has informed the guest of the payment due date when specifying the deadline for the deposit.
Article 4 (Special Provision Exempting Payment of Deposit)
Notwithstanding the provisions of Article 3, Paragraph 2, the hotel may agree to a special arrangement whereby payment of the deposit specified in that paragraph is not required after the conclusion of the contract.
2.When accepting an application for an accommodation contract, if the hotel does not request payment of the deposit set forth in Article 3, Paragraph 2, or does not specify the due date for such payment, it shall be deemed that the hotel has agreed to the special arrangement described in the preceding paragraph.
Article 5 (Refusal to Conclude an Accommodation Contract)
The hotel may refuse to conclude an accommodation contract in the following cases:
  • (1)When the application for accommodation does not conform to these Terms and Conditions.
  • (2)When there are no rooms available due to full occupancy.
  • (3)When the person seeking accommodation is deemed likely to engage in conduct that violates laws, public order, or good morals in relation to their stay.
  • (4)When the person seeking accommodation is clearly recognized as having a contagious disease.
  • (5)When the hotel is requested to assume a burden related to the accommodation that exceeds a reasonable scope.
  • (6)When accommodation cannot be provided due to natural disasters, facility malfunctions, or other unavoidable circumstances.
  • (7)When the case falls under the provisions of Article 11 of the Tochigi Prefecture Ordinance for Enforcement of the Ryokan Business Act.
Article 6 (Right of the Guest to Cancel the Contract)
The guest may cancel the accommodation contract by notifying the hotel.
2.If the guest cancels all or part of the accommodation contract for reasons attributable to the guest (excluding cases where, pursuant to Article 3, Paragraph 2, the hotel has specified a due date for payment of the deposit and the guest cancels the contract prior to making such payment), the hotel shall charge a cancellation fee in accordance with Appendix Table 2.
However, in cases where the hotel has agreed to the special provision set forth in Article 4, Paragraph 1, cancellation fees shall be charged only if the hotel has informed the guest, at the time of agreeing to such special provision, of the guest’s obligation to pay cancellation fees in the event of cancellation.
3.If the guest does not arrive by 7:00 PM on the day of the stay without prior notice (or, if an expected arrival time has been specified in advance, within two hours after that time), the hotel may deem the accommodation contract to have been canceled by the guest and process it accordingly.
Article 7 (Right of the Hotel to Cancel the Contract)
The hotel may cancel the accommodation contract in the following cases:
  • (1)When the guest is deemed likely to engage in conduct that violates laws, public order, or good morals in relation to their stay, or when such conduct has been recognized.

  • (6)When the guest fails to comply with prohibited matters set forth in the hotel’s rules of use, such as smoking outside designated areas, tampering with fire safety equipment, or other violations.
2.When the hotel cancels the accommodation contract pursuant to the preceding paragraph, the hotel shall not charge for any accommodation services or other services that have not yet been provided to the guest.

Article 9 (Hours of Use of Guest Rooms)
The hours during which guests may use their rooms are from 2:00 PM until 12:00 noon the following day. However, in the case of consecutive stays, guests may use the room throughout the day, except on the day of arrival and the day of departure.

Article 13 (Liability of the Hotel)

However, this shall not apply if the damage is not attributable to reasons for which the hotel is responsible.
2.The hotel has received the appropriate certification mark from the fire authorities and, in preparation for unforeseen events such as fire, is covered by ryokan liability insurance.
Article 14 (Handling When the Contracted Guest Room Cannot Be Provided)
If the hotel is unable to provide the contracted guest room to the guest, the hotel shall, with the guest’s consent, make every effort to arrange alternative accommodation under the same conditions.
2.If, notwithstanding the provisions of the preceding paragraph, the hotel is unable to arrange alternative accommodation, the hotel shall pay the guest a compensation fee equivalent to the cancellation charge, which shall be applied toward the amount of damages.
However, if the inability to provide the guest room is not attributable to reasons for which the hotel is responsible, no compensation fee shall be paid.
Article 15 (Handling of Deposited Items)
If loss, damage, or other harm occurs to items, cash, or valuables deposited by a guest at the front desk, the hotel shall compensate for such damage, except in cases of force majeure.
However, with respect to cash and valuables, if the hotel has requested the guest to declare their type and value and the guest has failed to do so, the hotel shall compensate for the damage up to a maximum of ¥150,000.
2.For items, cash, or valuables brought into the hotel by the guest but not deposited at the front desk, the hotel shall compensate for damage caused by the hotel’s intentional act or gross negligence.

Article 16 (Custody of Guests’ Baggage or Personal Belongings)
